Acceptance of Terms

By accessing or using the Saf O’ Me website, mobile applications, user portal, or GPS tracking devices (“Services”), you agree to be bound by these Terms and Conditions, our Privacy Policy, and any other policies issued by Saf O’ Me.

Eligibility

You must be at least 18 years old to register or use our Services. If you are using our Services on behalf of a minor or a dependent person, you confirm that you are their legal guardian and provide informed consent for their use of the Services.

User Responsibilities

You agree to:

  • Provide true and accurate registration information
  • Use the Services only for lawful and authorised purposes
  • Keep your login credentials secure
  • Notify us of any unauthorised use or security issues

Parental Consent and Children’s Use

Saf O’ Me devices may be used by children but must be registered and managed by a parent or legal guardian. By activating a child’s device or account, you confirm that you have lawful authority to provide consent for their data collection and use.

Subscription and Billing

Some features require a paid subscription. By subscribing, you authorise recurring payments via our provider (e.g., Stripe) and agree to maintain current billing details.

Cancellation and Refunds

Subscriptions may be cancelled at any time. No partial refunds are provided unless required under Australian Consumer Law. Cancellation will take effect at the end of the current billing cycle.

Data Use and Privacy

Your personal information is collected and handled according to our Privacy Policy. We may use anonymised or aggregated data for service improvement, research, and internal reporting.

Device Usage and Data Access

Features such as historical location logs, fall detection history, and SOS records are available based on your subscription level. Free plan users receive limited access. Data exports are available upon request in spreadsheet format.

App Permissions

Our mobile app may request access to:

  • Location data
  • Microphone (for supported emergency features)
  • Contacts and camera (for future functionality)
  • Health tracking data (planned Apple/Google integrations)

Permissions are optional but may affect feature availability.

Remote Voice Monitoring (Safe Pro Feature)

Remote voice monitoring is available only to users subscribed to the Safe Pro plan. This feature allows a pre-approved guardian or carer to remotely initiate one-way, silent audio monitoring on a Saf O’ Me device in response to emergencies (e.g., SOS trigger, fall detection, or prolonged inactivity).

This feature is:

  • Disabled by default
  • Enabled only with express consent given at the time of Safe Pro plan signup
  • Accessible only to verified guardians or carers through secure login

By enabling this feature, you expressly acknowledge and agree:

  • You are lawfully authorised to use this feature on behalf of the wearer (if not yourself)
  • Saf O’ Me does not record or store conversations
  • You accept full responsibility for how and when remote listening is initiated

Saf O’ Me will not be held liable for any unauthorised or unlawful use of remote voice monitoring by users who have given consent.

All use of this feature must comply with the Telecommunications (Interception and Access) Act 1979 (Cth) and relevant state surveillance laws.

Network and SIM Limitations

Saf O’ Me GPS devices require SIM-based connectivity. We are not responsible for service interruptions, inaccurate location updates, or device malfunctions due to network coverage issues or third-party provider outages.

Prohibited Uses

You must not:

  • Use our Services for unlawful surveillance
  • Modify or tamper with Saf O’ Me devices
  • Resell or sublicense our software or platforms

Infringe on Saf O’ Me’s intellectual property

Limitation of Liability

To the extent permitted by law, Saf O’ Me will not be liable for indirect or consequential losses, including those caused by:

  • SIM/network failures
  • Improper use of emergency features
  • Inaccurate or delayed data transmission

Indemnity

You agree to indemnify Saf O’ Me against any claims, liabilities, or costs resulting from:

  • Breach of these Terms
  • Misuse of the Services or devices
  • Unlawful use of remote monitoring features

Changes to Terms

We may amend these Terms periodically. Updates will be posted on our website and/or app. Your continued use of the Services constitutes acceptance of the revised Terms.

Governing Law

These Terms are governed by the laws of New South Wales, Australia. Legal disputes shall be resolved in the courts of Sydney, NSW.
